CODE OF CONDUCT
VAELA UnProgram September 2021
In consideration for participating in VAELA’s 2021 UnProgram held at the Kingsmill Resort in Williamsburg, Virginia (“UnProgram”), I hereby acknowledge and agree to the following:
1. I understand the hazards of the novel coronavirus (“COVID-19”) and I am familiar with the Centers for Disease Control and Prevention (“CDC”) and the Virginia Department of Health (“VDH”) guidelines regarding COVID-19. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC and VDH guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates.
2. I understand that because of the uncertainty of COVID-19 regulations and CDC and VDH guidelines are subject to change, and that the UnProgram may be modified and/or cancelled accordingly.
3. Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in the UnProgram.
4. I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the UnProgram and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Virginia Academy of Elder Law Attorneys, the members of the Education Committee, Board of Directors, Officers, agents, employees and assigns (the “RELEASEES”) from any liability related to COVID-19 which might occur as a result my participating in the UnProgram.
5. I shall indemnify, defend and hold harmless the RELEASEES from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action is brought on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, my exposure to or my becoming infected by the coronavirus or developing COVID-19 or any related illness or injury as a result of my being on the premises and participating in the UnProgram.
6. I agree to comply with all COVID-19 related procedures that may be implemented by VAELA and/or Kingsmill Resort, including, but not limited to, mask-wearing and social distancing requirements, and restrictions on certain activities that carry higher COVID-19 related risk, in order to protect as much as possible the health and safety of all UnProgram attendees.
7. Taking into account current CDC and VDH guidelines, I AGREE TO TAKE ALL REASONABLE AND NECESSARY STEPS BEFORE AND DURING THE UNPROGRAM TO MITIGATE ANY EXPOSUSRE TO COVID-19.
